A Wake County sheriff's deputy has been suspended without pay after being charged with driving under the influence.

A Wake County sheriff's deputy has been suspended without pay after being charged with driving under the influence.

A sheriff's office representative said Deputy Joseph Milinichik, 43, was charged Dec. 6 on Alexander Drive in Durham County. According to the state Carolina Highway Patrol, Milinichik had a blood-alcohol level of .13. The legal limit in North Carolina is .08.

Milinichik's suspension is pending the outcome of the case. He is scheduled to be in court to face the charge Jan. 18.
