Wake County sheriff's deputies arrested David Bernard Eichacker, 31, of 1928 Majestic Oak Circle, on Wednesday.

<b>WENDELL, N.C.</b> — A Wendell man is accused of having sex with a 5-year-old child.

He was charged with rape of a child and sex offense with a child, according to the arrest warrant.

The alleged crimes occurred between February and May of this year.

Eichacker was being held Wednesday in the Wake County Jail under a $3 million bond. He was scheduled to be in court Thursday.

Eichacker was already on probation for a taking indecent liberties with a child offense, according to state Department of Correction records.

WRAL News was told that 24 students were on board, ages 5 to 11. Two students were taken to WakeMed for femur fractures and facial lacerations. Seven other students were taken to a hospital in Smithfield.

Deputies said they commanded the man to drop the weapon and raise his hands. However, they said the man refused to comply and instead fired two rounds. A deputy fired his gun, hitting the man.
