Teen brothers indicted on murder charges in fatal shooting

A Wake County grand jury on Monday indicted 13- and 15-year-old brothers in connection with the shooting death this summer of a 16-year-old Raleigh boy.

RALEIGH, N.C. — A Wake County grand jury on Monday indicted two teenage brothers in connection with the shooting death this summer of a 16-year-old boy.

Brayan Hernandez-Sierra, 13, and Ceferino Hernandez-Sierra, 15, were each indicted on a count of murder in the death of Fernando Garibay-Benitez. He was shot in the head on Aug. 15 while he was walking home from the store.

Witnesses testified in a hearing last week that Brayan Hernandez-Sierra fired several shots from a minivan driven by his brother.

Investigators believe the shooting was gang-related.

The pair had been initially under the jurisdiction of the juvenile court system, but a judge last week found that they could be tried as adults.

Still, they are ineligible for the death penalty. A U.S. Supreme Court ruling limits it to those over age 18 at the time of a capital crime.
