State Supreme Court to Hear Peterson Appeal

Posted August 3, 2007

— Convicted murderer Mike Peterson will have his appeal heard before the state Supreme Court on Sept. 10.

Peterson, 63, was convicted in October 2003 of first-degree murder in the 2001 beating death of his wife, Nortel Networks executive Kathleen Peterson. She was found dead at the bottom of a staircase in their Durham mansion.

The former Durham mayoral candidate and novelist, who contends his wife fell down the staircase, is currently serving a life sentence at Nash Correctional Institution.

Earlier this year, Peterson reached a $25 million settlement with his stepdaughter, Caitlin Atwater, in a wrongful death suit. The settlement also states that Peterson admits no guilt or liability in the death of his wife.

I haven't heard all of the evidence, but I don't think they should have let in the evidence about another person in Germany falling down a stairs. The autopsy revealed that lady died from Stroke.. and they shouldn't have allowed testimony to this guy's sexual preference either. It had nothing to do with the case and probably desimated the way some jurors thought about him. I'm not a rainbow warrior but this is a murder trial, it should have been about the facts not that this guy likes other guys. He'll probably get a new trial.

He can still appeal to the US Supreme Court. and for some reason, I don't think this guy did it.

I sincerely hope that this is his last resort.

I am correct that this is his last resort? If he fails to get his case turned on appeal will it finally be over?
