Man accused in slaying over kid's baseball bat accident

A man is dead and another man is charged with murder after a baseball bat accident involving their children near Waters and Holly streets in Goldsboro.

GOLDSBORO, N.C. — A man is dead and another man is in jail after a baseball bat accident involving two Goldsboro children.

“I heard screaming, and I looked out the window and I saw the guy with the gun,” neighbor Tierra Brink said.

Brink said two neighborhood boys had been playing near Waters and Holly streets on Saturday when one boy accidentally hit the other boy with a metal baseball bat.

Brink lives next door to the boy who was hit.

"His son came home with a big lump on his head and James (Brewington) was kind of upset, so he went to find out what happened," she said.

Witnesses said James Brewington, 29, came out on the street to confront the boy who hit his son. That boy went home crying to his father, Timothy Vaughn, 36, who then came out to confront Brewington.

A neighbor, who spoke on the condition that she not be identified, watched from her front porch as the men argued. She said Vaughn pulled out a gun, surprising everyone watching.

"He reached back and shot him twice in the stomach. He pushed him off of him, like, 'Get off of me,' and shot him in the neck,” the witness said.

The witness also said she drove Brewington to the hospital.

"He was gasping for air, but he was still breathing,” the witness said.

Brewington died en route to the hospital, authorities said.

Vaughn, who was charged with murder, was being held Tuesday evening without bond in the Wayne County Jail.

He is scheduled to appear in court on June 30. WRAL checked his criminal record and found a previous charge for assault on a woman, as well as some other minor charges.

Vaughn's family would not comment Tuesday night.
