Durham Judge Rules Same-Sex Couple Should File Lawsuit In Superior Court

DURHAM, N.C. — Two Durham men are suing to get a marriage license, but a district court judge told them to find another court.

In March, the Durham County clerk's office denied Richard Mullinax and Perry Pike a marriage license. The pair is now suing the county to get one.

Judge Craig Brown dismissed the suit Monday, ruling the case should be heard in a different court since it involves constitutional issues.

Mullinax and Pike plan to refile their lawsuit in Superior Court.
