Posted Updated

DURHAM, N.C. — A Durham police officer, D.A. Gaither, temporarily has been assigned to administrative duty following an incident in which the officer shot a suspect Sunday morning.

At approximately 3:20 a.m., according to police, Gaither and another Durham officer were at the Durham Hilton on Hillsborough Road when they heard multiple gunshots coming from the parking lot area. The officers investigated and encountered a suspect in the parking lot.

Police said one of the officers saw that the suspect -- identified as Marlon Deshaun Williams, 29 -- had a handgun in his waist area. When ordered to lie on the ground, police said, Williams did not comply and turned toward Officer Gaither. Williams reportedly removed the handgun and began raising it in the direction of Gaither.

Gaither fired his duty weapon and struck Williams in his upper right thigh.

Williams was treated at Duke Hospital for his injury.

Upon his medical release, Williams was charged with assault with a deadly weapon upon a government official, and resisting and delaying a public officer.

Bond was set at $100,000. Williams is schedule to make his first court appearance Tuesday.

The State Bureau of Investigation is conducting a investigation of the shooting.
