Carlos Guerra is accused of stealing mercury from a scrap metal company in Garner. Investigators said he gave the material to four children at a Durham church, who then took it to Oak Grove Elementary School.
In August, Guerra was granted the opportunity to enroll in the state's First Offender's program. The state approved Guerra to enter the program because he does not have a prior criminal record.
In the program, he must complete 75 hours of community service, pay a $200 fine and not get into trouble for the next six months.
If Guerra fulfills the program's requirements, a misdemeanor larceny charge against him will be dropped.
Guerra will appear in court February to see if he has met those requirements.
