Durham Judge To Rule Whether Lost Evidence Could Lead To Lawsuit

DURHAM — The city of Durham and a former employee could be facing a lawsuit because of botched evidence in a criminal case.

On Monday, a judge heard arguments from the city's lawyer asking for the case to be dismissed.

Yvonne Walker filed a civil suit against the city and former police evidence technician Bruce Preiss. In 1998, Walker was brutally raped and beaten into a coma.

The case against her former boyfriend was dismissed when Preiss admitted that he drove around with the evidence in the trunk of his car for months and then threw everything away.

The judge is expected to rule in the next day or two whether or not the lawsuit can move forward.
