— A Fayetteville man has been charged in an accidental shooting death over the weekend, police said Monday.

Officers responding to a home in the 6500 block of Wicklow Place at about 11 p.m. Saturday found Erline Freeman, 26, had been shot. She was taken to Cape Fear Valley Medical Center, where she died.

Investigators determined that a gun was knocked from its storage location and discharged when it hit the floor, with the shot hitting Freeman.

Richard Pugh-Newby, 28, who lives at the home, was charged with involuntary manslaughter. He remains in the Cumberland County jail under a $15,000 bond.

Anyone with information about the shooting is asked to call Detective J. Walker with the Fayetteville Police Department at 910-433-1856 or Crime Stoppers at 910-483-8477.

Well if it discharged when it hit he floor obviously the gun was loaded and did not have the safety on.
"Involuntary manslaughter usually refers to an unintentional killing that results from recklessness or criminal negligence, or from an unlawful act that is a misdemeanor or low-level felony"

Seems to me the police determined the gun was his. If it was, it is the definition of involuntary manslaughter.

I am all for locking up folks, but how is this his fault. It fell off of a storage area and discharged. This sounds like a terrible accident.
