A Durham County magistrate suspended from his job fought back Tuesday against accusations he lied on his job application.

DURHAM, N.C. — A Durham County magistrate suspended from his job fought back Tuesday against accusations he lied on his job application.

According to court documents, Magistrate Sam Biers is accused of falsifying his date of birth on his employment application to conceal a criminal record. Sources told WRAL he was convicted of felony breaking and entering in Michigan, and that conviction was expunged.

Biers denied having a criminal record and filed paperwork Tuesday saying those who spoke out against him had lied.

A hearing on the matter is expected later this month.
