Charges upgraded in Cary crash that killed toddler

A 20-year-old Cary woman faces a misdemeanor death by motor vehicle charge in a three-car crash earlier this month that killed a toddler.

CARY, N.C. — A 20-year-old Cary woman faces a misdemeanor death by motor vehicle charge in a three-car crash earlier this month that killed a toddler.

Elizabeth Blake Brzezinski, of Milley Brook Court, was initially charged with failure to reduce speed, but that charge was upgraded Thursday after 20-month-old Chloe Rene Fox died from injuries she sustained in the crash. 

Brzezinski could be sentenced to up to 150 days in jail if convicted.

Chloe was riding in a 2006 Toyota with her parents on U.S. Highway 64 near the Edinburgh Drive intersection on July 6 when the car was hit from behind as it slowed for traffic by a 1999 Ford, police said.

The collision forced the Foxes' car into the back of a 2011 Chevrolet, and the Toyota was eventually hit on the side by the Ford, police said.

Chloe was in a child car seat, but police said it appeared that the seat wasn't installed properly.

She was taken to WakeMed in Cary, where she died earlier this week.
