Two years after the death of Kyron Hinton, his family learning new details about how he died. Why he died and why no one has been charged are still mysteries to them.

Hinton was assaulted by several law enforcement officers during an arrest in 2018. Those officers were charged, and Hinton was awarded $80,000 in 2019 to settle a lawsuit in which he claimed a Wake County deputy used excessive force in that arrest.
The day after the settlement was announced, Hinton was dead.

His mother, Vicky Hinton, who lives in Kinston, said she is still heartbroken by her son’s death and even more disturbed by the details in his state autopsy report, which shows he died from cocaine toxicity and strangulation.

This was news to the family, the mother of Hinton's child told WRAL News.

Wake County District Attorney Lorrin Freeman told WRAL News that Hinton was physically restrained at a home on Cooper Road before he died.

"Mr. Hinton appeared to be having an episode in which he was erratic and physically lashing out," she said.

But Freeman says there are no grounds to charge anyone with murder. She says the person who restrained Hinton was a juvenile and had developmental disabilities.

"There is an individual in the house that we've known about all along who admitted, who we received information has been involved in restraining Mr. Hinton," Freeman said. "There’s a lot of questions about what happened there. There’s not enough evidence to move forward with charging someone.

Vicky Hinton said she knew her son was a drug addict, that he struggled with mental health issues, but that he was also a human being, and she is struggling to understand why he died.

Freeman says authorities have tried to keep Hinton's family in the loop, and that Hinton's past – his arrest and drug use – did not impact how his death was investigated.

"We have met with the family and spoken with the mother at least a dozen or more times over the last year or more," she said.

She says Hinton’s past did not impact how his death was investigated.
