'This is a man that cannot be allowed to drive:' Suspect in cyclist's death being sued for role in crash on I-540
For the second time in a week, a Wake Forest man appeared in court for his role in a crash.
Posted — UpdatedOn Monday, Grady was in court for his role in an October crash on Interstate 540.
Erik Chavez was on his way home from a martial arts class and was stopped to fix a flat tire.
"I'm walking, and all the sudden, I'm in the air," he said, noting that his training in Brazilian jiu-jitsu helped him understand how to land.
"I landed. I rolled," Chavez said. "All the sudden, I'm on the floor and I'm just screaming because I'm in pain. I'm bleeding. I'm screaming."
Chavez had to have a rod implanted to fix a broken leg, and only recently was he able to go back to work.
When he found out that the driver who hit him was suspected of killing a woman, Chavez said, he broke down, wondering why Grady was back on the road.
"One is enough," he said. "You hit someone once, and it is enough. I think that's pretty unfair for the family who lost that woman, and unfair for me as well."
"I hope he gets help. I truly do," Chavez said. "I hope he gets help, and I hope he realizes what he has done, and he sits with that for a long time."
Chavez and his girlfriend are suing Grady in civil court. Their lawyer said, "I think the state should consider strengthening laws regarding people who drive with licenses revoked due to drunk driving."
"It's very disturbing that not only was Mr. Grady driving in the condition that he was, but that he had no insurance whatsoever," attorney David Sherlin said.
If that's the case, Chavez's insurance may end up covering his rehabilitation.
Grady is jailed with a $1 million bond on the charges in LaRobardier's death.
"This is a man that cannot be allowed to drive, period. The state will figure out the best way to make that happen," Sherlin said.
