After nearly 21/2 years, North Carolina may finally have a state budget.

Good afternoon, welcome to the weekly edition of the Rap. I'm laura Leslie WRL capital Bureau chief and I'm Travis Fain WR Eells Statehouse reporter, the Legislature may have been out of town this week, but that doesn't mean there wasn't plenty going on. Um I think most notably the news broke last night that Madison cawthorn, our current 11th district congressman is going to be running in the newly created 13th district. That's the one that was centered right over Cleveland county, where the house speaker, two more lives, And then two more announced shortly after that that he's not going to be running for the 13th District. So that's kind of a let's put it this way, it's sort of upset some assumptions that have been sort of fundamental for the last few months, doesn't it? Yeah, Madison cawthorn, tipping dominoes over here and getting himself, You know, into the Charlotte suburbs with that 13th district where he'll bigger media market, yeah, bigger media market, like they'll have to talk about him in Charlotte, we're talking about him now, I I'm gonna go out on a limb and say that was a big part of the goal here, wants to run statewide someday. He said, you know, I'd like to be governor. Uh he's young enough to get the 30 under the constitution, so he couldn't run until 2028 but you know, he's taking a step toward that. And how about more? Yeah, I was talking to a Republican operative today who of course did not want their name attached to it because you can't criticize donald trump or Madison cawthorn right now in the republican party, even if you disagree with them. Uh, and he said, you know, how about that? You know, one of the most powerful republicans in the state, just immediately backing down from a challenge because of a 26 year old first term congressman from western north Carolina who lets in fairness, let's point out, did post a video to twitter, making this announcement, calling, calling out tim or in everything but name, oh yeah, establishment go along, get along. So called republicans, something along those lines while more and other house republicans were at a $30,000 per person fundraiser in duck north Carolina. I don't know if call thorns folks knew that, but the house and I believe senate republicans as well are having their annual or every two year I guess uh, fundraiser down on the, down on the coast last night. And uh man, I bet that was a real interesting room or rooms to be in when Madison called thorne's announcement, hit the internet. I was recording on the record with Lena Tillett we're doing, talking about redistricting this week and we had just stopped taping the show when our guests, it was wily nickel and senator dan blue. And then we also had Michael Watley and see GOP and Ashley Hildebrand from two and like all four of them as soon as we stopped rolling, like, oh my gosh, look at twitter because everybody just saw their cawthorn in the mornings, you know, so it's like, man, you can't even turn your phone off for half an hour to shoot a show anymore, you know? Right, right. Uh you know, a more cawthorn race would have been interesting because I think it would have forced an open conversation. I think I've said before that there are of course multiple types of republicans, but maybe the two biggest factions right now are, you know, people who really like and back Madison cawthorn, kind of the grassroots, burn it down, sort of republican and people who really don't like that, but don't feel like they can speak out. Um so they just kind of silently assent to it. This would have forced that conversation, right? It would have been a microcosm, which I'm sure national journalists would have just lapped up of a kind of the warring sides of the party And reinforce that into the open that in a way that would have been interested be interesting to see who does step up and running the 13th as a Republican against Cawthorn. I assume they're not. There's one, uh there's one already, I think her name is Bentley, she is a former Mecklenburg County Commissioner, so she announced that yesterday morning before cawthorn made his announcement, but after it was known that he was considering it and I suspect you'll see quite a few more, I mean, given that location and the fact that such a safe district there's probably plenty of folks that would like to challenge course Madison cost Madison cawthorn is coming into this with a gigantic war test. And that is probably part of the calculation for anyone who's thinking about getting involved in this primary. I mean, he basically has parlayed his high media profile into a pretty tremendous national fundraising organization and and that's probably not going to get any worse for him once he gets into a bigger media market. Yeah, absolutely. I mean, or at least a massive cash flow. He's his burn rate is is something is something impressive. But I don't, you know, when was the last time you saw somebody with that much name recognition run out of money doesn't happen often. In the meantime. We also heard scuttlebutt this week that some folks in high up in the Republican Party nationally are trying to talk Mark walker into dropping out of the U. S. Senate race and running for the district that's just opened up for him. Um, and um, I don't remember, is it six? Uh I the thing about being in north Carolina is there's always a lawsuit and there's always an old map and there's always a new map and there's always a potential of a new new map. It's a little hard to keep the exact lines in your head. So I don't remember. But I mean that's wherever it is, it would probably be easier than ted, but Ted buds old district because Ted Budd is running for Senate. So, um so anyway, right now, I mean, Ted Budd and McCrory appeared to be sort of the front runners in that race. So we'll have to see what kind of decision Mark walker makes. It would be sort of returning to his roots because I think a lot of those counties or county that he also once represented. So be interesting to see whether that happens uh surprising to see him step step away from the U. S. Senate race. No, I mean, why? Yeah. So, um so anyway, in the meantime, as you say, we've got maps and we have lawsuits, we have two lawsuits. Uh so lawsuit we learned about last friday and got more information on monday as the second lawsuit against the maps, Except that it's not really a new lawsuit or at least that's what they're trying to do. You may remember that back in 201,980, was it? Uh there was a state suit in front of a three judge panel against the maps for the current maps that they had at the time for partisanship for extreme partisan gerrymandering. And the three judge panel found in favor of the plaintiff in that case, they had to redraw the state maps. Well, that was a preliminary injunction that nobody ever challenged, but that case never really closed. So what is happening uh sort of on a national level is that a group is sort of trying to add on to that lawsuit reopened that case with those three judges, um and bring these new maps in to have a look at those as well. Now, I don't know what the odds are that that's going to be allowed to go through or that they're just going to be told to file a new suit. Yeah. And then one of the things that in the previous suit, not not the one we're talking about amending, but a previous suit on these maps that attacked the process. One of the things they wanted was to delay filing, Right? And so you wonder if some of the legal uncertainty there does end up delaying filing as we simply try to discuss the right way to sue Over this. Um I kind of doubt it because I mean, I'm just looking back to like 2011, I mean, think about it. You know, the suits for those maps in 2011 came down real quickly. But even so we had elections in 2012, and 2016 under those maps before any election was ever stopped because of legal uncertainty. That's right. Could could be business as normal and then we go back and do it in different types the next cycle. And that's one of the things that the plaintiffs in the case um in the first case, you mentioned the case, we're trying to make that, you know, lawmakers have had, this has been there, they're sort of, the strategy is to run out the clock and then say, well, we can't change maps now, it's too late. So, you know, they're trying to say, well, let's delay that so that they don't have the option to do that. I have not heard anything about a scheduled hearing in any of those cases yet, So um and filing starts December six, so it's not like there's a whole lot of time for that. So we'll be watching that closely. Um also watching closely the budget, we're gonna have a budget next week, we think were told monday ish, monday ish. Yeah, it looks like the Republican majorities are, they've gone as far as they feel like they can with the governor, they say they're going to vote through a budget that has things the governor likes. Sounds like some democrats are going to go along with them and then we'll be up to the governor to decide if you want to throw it on the table for Medicaid expansion or whatever else is left out. There won't be Medicaid expansion in this budget. Is he going to go to the mat uh and veto it and run the risk of having his first veto override ever. Are democrats gonna hang with him. You know, that the normal calculus is, you have democrats will hang with him, I'm not so sure that holds this time based on so much money at stake at this point. And it's been so long since they've gotten a new budget. You know, and the teachers haven't had a raise and, you know, any any any lawmaker who votes against this budget is going to have to go home and answer to the teachers in the district about why there's a real it's time field around the building, right? Like there's a real feeling of all right, we just we got to do this. And I mean, the governor, he's gonna, he knows that, you know, he he's a brilliant political mind. So I I'm guessing he signs it, but I don't have any inside information. Ah One way or the other, I suspect. Yeah, I I will be surprised if there is a veto, but you know what? I've been surprised before. So yeah, that that in $2 to get your coffee. Okay. So, um, I wanted to mention the big, big story of this week, um that we've sort of haven't been talking about, which is Leandro. Yeah. Speaking of lawsuits that have been around forever. Um, a judge or the state legislature to spend $1.7 billion dollars and we don't really know what's next. You've done some reporting on this today? Yeah. Well, actually, he didn't order state lawmakers. He ordered the state executive branch. So This is Judge David Lee he's been warning lawmakers all year, like at each of these hearings saying we're gonna we're ready to move on this. It's time to come to the table you need to do something here and they haven't. And uh so he pulled the plug on Wednesday and said all right $1.7 billion dollars dispersed from he's calling on the treasurer and the controller and then um oh SBM to disperse it to U. N. C. System. Um DHHS and and the majority of at 1.5 billion or so goes to D. P. I. To implement this remedial plan that all the sides and the lawsuit had agreed to. Of course I mean to no end of storm and wrong from the House speaker tim moore and Senate leader Phil berger calling it a circus calling him a rogue judge who is exceeding his authority in making this decision. But it's really unclear what's the next step here. Um And I'm gonna have a story on that coming up on N. C. Capital this afternoon. But I mean in a nutshell it's not clear at this point who has the authority to step in under what grounds and what that would actually look like. Yeah I mean do Republican lawmakers try to join the case? Remember the judges said they're already party to it even though they say they're not they're not and they're technically not and they don't have legal representation. You know it does. My guess is Treasurer Dale Falwell. If there is a legal challenge to be filed, he files it that's where you know the procedure leads. That's one way to do it. But I mean at the end of the day, that's all kind of legalese and and process and just to have a judge tell the state to spend, you know, this much money or any amount of money really on education because the constitution demands. It is fascinating and you know, the phrase constitutional crisis is getting thrown around. You know, it's a crisis, if you call it a crisis is a crisis. People act like it's a crisis. It's certainly unprecedented. It's some strange territory to be in right where as opposed to the legislature coming to an agreement on on money, a judge is ordering spending. So I I have to eat some pro here. I did not think we would get to this day. I actually, even on Wednesday morning, I was I was thinking, yeah, he's just gonna fight, he's going to hold him in contempt. He's not really going to do that. Uh Well, yeah, he did. He totally did. Um So um yeah, so of course this opens the door to a lot of questions about how that money is going to be used. Um there is a possibility of course that legislators could come, they could basically come together right themselves a bill, spend the money under their own authority as mandated by the court and get out of this whole situation right. That would make the order move because the judge paused it for 30 days so they have the opportunity to do it themselves if they want to. But I have not heard any talk about that happening. What I have heard talk about in some circles is whether or not that they should try to impeach the judge in this case. David lee for exceeding his violating the constitution and exceeding his authority. Well, I mean, number one, we've never impeached judge in north Carolina should be brand new. Um Number two, you can probably impeach him in the house because that's where the impeachment vote is and that's a simple majority. But today you need to convict him in the Senate and that you need two thirds of a vote, two thirds vote in the Senate. And that is by my count at least 32 probably 33 out of 50. Um And and that would mean four or five democrats would have to go along with the republicans on that one. So I just don't see that happening anyway. And I don't know what it gets you. He's semi retired anyway. Although I don't know if you get to keep your pension if you've been impeached. That that would seem to be important for him personally I would think. But Uh huh. I don't know. I've written down in the history books. Yeah, I just I just don't it seems like that it's just something that's going to keep them in town longer and to what end. Yeah. Yeah. I think I think we can all sign off on things that make them leave Raleigh the Legislature and pretty much everybody wants to go home. We can't miss you if you don't go away. Yeah. Um So anything else you wanted to get to know? I think that's it. You know we we will be talking in the coming weeks and days about the budget will be talking about who's running for what But you know at this point it's still a little early. Yeah. Well please do keep an eye on N. C. Capital. As soon as we get a look at that budget we will let you know what we're finding in it and um and then we'll let you know how it all goes down. I suspect it will be a fairly typical probably budget debate but there'll be a lot of democrats voting for it. It'll take all day Tuesday and Wednesday and then everybody will be done. I'm meteorologist K Campbell in the wr a severe weather center starting a new week on Monday. So here's what to expect as you gear up for the new week. Rain chances will be climbing, especially Tuesday and Wednesday. We are going to get a nice little break from the heat this week. So enjoy the spring like weather while it's here with us no more nineties on our seven day forecast, I would say the best days to be out and about do anything outside look like they're gonna be on Monday and Thursday of this week. So here's this set up. We've got a lot of moisture and rain falling in parts of Texas, Louisiana, Arkansas. Right now, we're going to see all the moisture from this system and some of the energy make it to North Carolina starting Monday night, Monday during the day, things should be dry. We've got this area of high pressure overhead but we will begin to see an increase in cloud cover throughout the day. And then late Monday night, we'll see a warm front lift through the area that could generate some spotty light showers overnight into Tuesday. And then during the day. Tuesday, we've got more lift in the atmosphere. It's a cloudy day, a much cooler day and we should see rain on and off throughout the day. But rain is likely you'll at least get a period of rain. Tuesday. More than likely it's, there should still be some breaks in the rain at least. And then some thunderstorms could be mixed in as well. This is as far out as that high resolution model goes right now, but we've got a nice break from the heat coming our way. 79 is our normal high. This time of year, we're going to be near or slightly above normal most days. The exception is Tuesday with the highest rain chances, temperatures will be a little cooler just 73 for the high tonight. It's a cool night, really, comfortably cool. Enjoy it while you can. It's probably one of our last ones of the season. Upper forties to lower fifties across the area tonight. 50 Raleigh 49 in Rocky Mount. And for your Monday forecasts, ties are in the upper seventies for Roxboro and South Hill. 81. The high in Durham, Raleigh Rocky Mountain, Southern Pines, 82 degrees in Fayetteville and Goldsboro. Your seven day forecast looking pretty nice. But we've got rain chances coming our way Tuesday and we'll see some scattered storms on Wednesday as well. It's about a 60% chance Wednesday, but an 80% chance Tuesday, Thursday, rain chances are lower at just 20%. 82 degrees and partly cloudy Friday late in the day into Saturday, we could see some scattered storms move in. Not looking like a washout though. It does look like we'll have a drier into next weekend. 84 partly cloudy next Sunday.
