Tax Preparer Charged With Filing Fake Returns
A Cumberland County tax preparer has been charged with preparing phony income tax returns, authorities said.
Posted — UpdatedHerbert L. McMillan, 46, of 5305 Sierra Court in Fayetteville, was charged with 25 felony counts of aiding or assisting in the preparation of fraudulent state tax returns and two counts of willful failure to file income tax returns.
McMillan is the owner of Tax America in Spring Lake.
Agents with the state Department of Revenue said he knowingly prepared and filed false North Carolina individual income tax returns for 11 clients from 2004 through 2006, prompting the state to issue excess refunds.
McMillan was also charged with failing to file his own North Carolina individual income tax returns for 2005 and 2006, authorities said.
