Retrial of Jason Young scheduled for Jan. 9

A judge has set a Jan. 9 retrial date for Jason Young, charged with first-degree murder in the November 2006 death of his pregnant wife, Michelle Young.

A Superior Court judge in Wake County has set a Jan. 9 date to retry a man accused of beating his pregnant wife to death nearly five years ago.

Jason Young, 37, is charged with first-degree murder in the death of 29-year-old Michelle Young, who was found dead in the upstairs bedroom of the couple's Wake County home on Nov. 3, 2006.

His first trial ended in a mistrial in June after a jury couldn't reach a unanimous verdict.

The new trial was scheduled to begin next month, but Judge Donald Stephens delayed it to give a court reporter more time to finish transcribing the original proceedings.

Jason Young, who was arrested in December 2009, has maintained that he was out of town when his wife was killed and that he had no involvement in her death.

Defense attorneys argued that someone else, possibly two people, killed Michelle Young, noting DNA evidence found inside the house didn't match Jason Young and that there was no physical or circumstantial evidence implicating him.

During a routine court hearing Thursday, prosecutors said they plan to present evidence at the new trial that wasn't in the first.

Jason Young, meanwhile, is out of jail on a $900,000 secured bond.
