Former Rocky Mount police cadet Shirley Moore takes a polygraph test. Moore charges she had an affair with the department's police chief and was forced to resign after his wife found out.

A Rocky Mount couple has dropped a lawsuit against the city and Police Chief John Manley Jr., City Manager Stephen Raper announced Friday.

Shirley and Jerry Moore dismissed their suit with prejudice, meaning they cannot refile it, on April 21. No payment or other consideration had been made by either the city or Manley, Raper said.

Shirley Moore, a former police cadet, claimed she lost her job over an affair with Manley. She claimed Manley paid for an abortion and then forced her to resign in 2007.

She failed portions of a polygraph test sponsored by WRAL News. Her answers about the affair came back inconclusive.

The city's own investigation cleared Manley in May 2008.
