The Atomic Fern bar in Durham is suing the state of North Carolina and the City of Durham for $25,000 for lost revenue stemming from coronavirus pandemic restrictions.
The bar says it accepts the mandates restricting reopening due to COVID-19 concerns, but they need the money to maintain the business and believe they should be fairly compensated.
Attorney for The Atomic Fern, Daniel Meier, explained the bar's stance in a statement.
"We agree with the mandates, we just say it was an unjust taking without just compensation -- we aren't trying to reopen, just trying to save the business."
