Raleigh police reviewing incident in which teen was pinned to ground

RALEIGH, N.C. — The Raleigh Police Department is reviewing the actions of an officer who pinned a teen to the ground Friday while a cousin captured it on video.
Jastina Muir, who spoke only to WRAL News, said, "They said they were detaining my son because he looked armed and dangerous. Those were his exact words. He looked armed and dangerous. They thought he had a gun by the way he pulled his pants up."

An RPD spokeswoman said the officer thought the teenager was armed and asked to search him. When the teen did not comply, the officer grabbed him.

The video, which was shared with WRAL on Instagram, shows the officer grabbing Diego Muir around the back, restraining his arms and eventually pushing him to the ground while radioing for help. The officer sits on the teen's back with a knee on his upper left arm while the person recording the video pleads for bystanders to help.

After about a minute and a half, the pinned teen can be heard saying, "Sir, I have asthma, please, you are really hurting my arm."

Tom Earnhardt, a retired police captain, said the situation could have been avoided if Diego Muir complied rather than backing away from the officer.

The teen, who turned 15 on Monday, was never charged with a crime, although officers took him into custody and put him in handcuffs in a police car, his family told WRAL News. He was released to his mother.

Raleigh Police provided an incident report related to this case listing misdemeanor offenses to include resisting an officer. Police tell us a juvenile petition will be sought in this case.

Diego Muir said of the incident, "It makes me feel really sad."

His older brother, Antown Peterson, said, "We should not be afraid of the cops. We’re supposed to call on the cops if we’re afraid for our lives, but the other day my little brother was afraid for his life."
