SPRING LAKE, N.C. — No charges are expected to be filed in the weekend death of a pedestrian in Spring Lake, police said Wednesday.

Benito Gonzalez Clemente, 32, was trying to cross the 600 block of North Bragg Boulevard on Saturday night when he was hit by a 2006 Mercury Milan driven by Bernard Carnegie, police said.

"The investigation concludes that the victim’s alcohol consumption appears to have been a determining factor with his mental capacity prior to his attempt to cross the roadway," police said in a statement.

Security video from a nearby business helped police determine what happened.
