The man accused of shooting and killing a WakeMed Garner officer on Nov. 8 has been released from the hospital.

Benji Martin Jr. was released from the hospital and was taken to the Wake County Detention Center on Friday afternoon, according to Garner police. He was booked and formally charged just before 4 p.m.

Martin was dressed in white and escorted by several officers on his walk into the facility. His first appearance in court will come Monday at 1:30 p.m.

Roger Smith died in the shooting after a "struggle" ensued at the WakeMed Garner Healthplex.

Martin, who was shot in the altercation, was charged with murder. He was taken to the hospital shortly after the shooting and has been under medical supervision in the weeks since then.

Police said the shooting happened around 9 a.m. on Nov. 8 while Smith was on duty in the emergency department lobby.

Smith worked for Knightdale Police Department from 1997 to 2013 and was with WakeMed for more than a decade. He attended Garner High School.

Nearly a month after the shooting, Martin was indicted by a grand jury.
