Shoot-out with police in plan for Kinston teen

Kinston, N.C. — Court documents state two Kinston teenagers charged with first-degree murder in the death of a restaurant worker and a U.S. Marshal told a friend they preferred to "shoot it out with police" rather than go to prison.
Court document show a Kion Tyearl Dail, 16, told a friend he was involved in the June 2 death of kitchen worker Thomas Hinton and was prepared to resist arrest.
U.S. Marshal Warren Lewis III died June 9 from a gun blast through an apartment door as he and other officers searched a three-unit apartment building for Dail and other suspects.
Dail, Maretto Byrd, 26, Lamont D. Byrd, 18, Devine Slade, 17, and a 15-year-old are charged with first-degree murder in Lewis' death.
Lamont Byrd, Dail, a 14-year-old and a 15-year-old are charged in Hinton's death.
The names of the suspects under age 16 haven't been released.
