<b>RALEIGH</b> — A state appeals court has overturned a ground-breaking drunk driving conviction.

Timothy Blackwell is only the second person in the nation convicted of murder in a drunk driving case.

Last week, the appeals court ruled prosecutors wrongly used evidence from a plea agreement to convict Blackwell.
