Man May Avoid Death In Garner Slaying

RALEIGH, N.C. — A man accused of murdering his 15-year-old neighbor in Garner may not face the death penalty because of his IQ.

Kenneth O'Neal Jr. is charged with the murder and sexual assault of Amanda Maynard.

Lawyers for O'Neal said he scored a 69 on an IQ test a few years ago, which makes him legally retarded and ineligible for the death penalty.

O'Neal is set to go on trial in March.
