1 Killed, 1 Hurt in I-40 Accident

RALEIGH — The highway patrol says it will not charge the driver who hit two pedestrians as they walked along I-40.

One of the victims died.

The accident happened about 11:30 p.m. Saturday on the westbound lane at the Jones Sausage Road exit.

Investigators say the victim is 40-year-old John Dalton of Randleman.

The other man, identified as Danny Hussey, 33, is in satisfactory condition at a local hospital.

Witnesses told the highway patrol that Hussey wanted out of the car. They said Dalton pulled over, and then followed Hussey to get him back in the vehicle to go home to Randleman when they were hit from behind.

Trooper J.D. Henderson said the driver who hit them will not be charged. Henderson said nothing indicated that man was anywhere other than "where he should have been."
