State Courts To Hear Civil Cases Involving Truck That Hit Restaurant

RALEIGH, N.C. — Lawsuits against the truck driver who slammed into Peggy's Seafood Restaurant are shifting to state court.

The restaurant owner's son died, and two women were hurt in the accident last year.

All three families filed suit against David Brachear and his employer.

Brachear doesn't have enough money to cover the potential judgments.

A federal judge says those lawsuits should be heard in state courts. Lawyers for one of the victims plan to file a case next week.
