CARY, N.C. — A Cary man gets a small legal victory, claiming the Army does not have the right to call him to active duty.
Todd Parrish wants a federal injunction to keep the military from making him serve. Parrish was supposed to report to duty in two days.
A judge ruled he does not have to go until at least his case is heard. Parrish said he was only supposed to serve eight years, which he did.
The Army agrees he served his time, but officials said he never formally resigned, so he is still considered a reservist.
