CLAYTON, N.C. — A man shot by two Clayton police officers is improving.

Manuel Pena is now listed in fair condition. Police say they were searching his neighborhood for Rudy Gonzales Tuesday when he pointed a rifle at them. Police then shot Pena twice in the shoulder.

Pena's son said his father does not speak English and police used excessive force.

Officers eventually captured Gonzales.
