DURHAM, N.C. — Five murder suspects will not face the death penalty if convicted.

Gregory Lee, Jerome Freeman, Ricky Morris, Marcus Hawley and Michael Sullivan are charged in connection with the killing of Lois Cannady.

The 89-year-old was found shot to death in her home in June 2002.

Under state law, only Freeman, Lee and Morris were eligible for the death penalty, but the Durham County District Attorney's Office decided not to seek the death penalty.
