RALEIGH, N.C. — The North Carolina Department of Transportation was hit by a major ruling Friday.
The state has to pay a former Durham restaurant $1.591 million for shutting down his business.
The Pan Pan Diner was forced to close in February to make way for the I-85 construction.
The DOT originally offered the owner, Aubrey Foster, $207,000 for the property.
A six-mile stretch that runs from Highway 70 to Highway 15-501 has not had a significant upgrade since it was built in 1950. DOT officials said the Pan Pan sat right in the path of a new exit ramp.
