Former FBI Director James Comey's court date set for Oct. 21

U.S. District Judge Louise Flanagan has set the trial of former FBI Director James Comey over his Instagram seashells photo for Oct. 21.

Comey will be arraigned at 10 a.m. on Sept. 30 at the federal courthouse in New Bern, according to her order. 

But first: Comey is going to file motions to dismiss the case based on the argument that it’s a product of vindictive and selective prosecution, amongst other arguments. Flanagan noted Tuesday that Comey "plans to file multiple motions' seeking dismissal of the indictment, some of which, he observes, may be dependent upon discovery yet to be produced by the government.”

Pretrial motions are due July 28, and responses to those motions are due August 18. Replies to pretrial motions are due no later than Sept. 1, meaning we’ll likely see the judge rule on those motions before Sept. 30.
