GASTON, N.C. — The man accused of killing a Shelby police officer was back in North Carolina Tuesday night.

Irving Fenner, 23, is accused of killing officer Tim Brackeen who was shot in the chest during a Sept. 10 shooting and died two days later.

Authorities said Brackeen was trying to arrest Fenner on outstanding warrants when the pair shot at each other.

Fenner was arrested in Rhode Island on Sept. 14 and signed extradition papers last week to be returned to the state.

Fenner was being held in Gaston County Tuesday night.
