VALE, N.C.NBC Charlotte reports Mitchem's Kitchen opened for full service Monday night, defying Gov. Roy Cooper's executive order limiting restaurants to takeout and delivery only.

"I felt like it was time for someone to take a stand," said owner and Lincoln County commission chair Carrol Mitchem.

The restaurant was full and taking some precautions, like spacing out customers. However, wait staff were not wearing masks nor gloves, as some have been encouraged to do in South Carolina, where dine-in service is now allowed.

"You come here and you eat with 40 to 50 people, and you go to Lowe's and you're bumping shoulders with 150 to 200 people. I just don't really see the difference," said one customer.

The Lincoln County Sheriff served Mitchem a citation at the county commissioners meeting that night.

Gov. Cooper will announce this week if North Carolina is ready to enter phase 2 on Friday. Under phase 2, restaurants will be able to open for indoor dining but at 50% capacity.
