Johnston officials want to remove indicted magistrate

Johnston County authorities are asking a judge to remove a magistrate who was charged last week with improper computer use on the job.

SMITHFIELD, N.C. — Johnston County authorities are asking a judge to remove a magistrate who was charged last week with improper computer use on the job.

Magistrate Velody Foye-Byrd was indicted on three counts of illegally accessing government computers, which is a felony. Authorities said she went into a criminal justice database to get personal information on three people, none of whom were in her court on a criminal matter.

Johnston County Assistant District Attorney Jason Waller has filed a petition asking Chief District Court Judge Jacquelyn Lee to suspend Foye-Byrd with pay until she can be removed from office.

Superior Court Judge Tom Lock will hold a removal hearing for Foye-Byrd within 30 days.
