BENSON, N.C. — Virginia Johnson clearly remembers how the morning of September 28, 2020, unfolded.

Her son, 31-year-old Timothy Bates, was having a mental health episode.

"He suffers from severe depression and bipolar," said Johnson.

Johnson said it’s normal for family members to call law enforcement for assistance.

"We thought what we did was best for him to get help," said Johnson.

Now she questions that decision.

Security camera footage shows two Johnston County Sheriff’s deputies walking a hand-cuffed Bates to a patrol car. Johnson said then-Deputy Travis Hollomon came face-to-face with her son.

The video shows Hollomon grabbing Bates by the neck, slamming the back of his head into the car.

"Very intense. Very frightening at the time," said Johnson. "I went through all kinds of emotions."

Hollomon joined the Johnston County Sheriff's Office in June of 2019.

Sheriff Steve Bizzell told WRAL News Hollomon was terminated immediately in October 2020.

"When I looked at the video, that's all the investigation I needed. It spoke for itself," said Bizzell

Sheriff Bizzell turned the video over to the district attorney, who in turn asked the State Bureau of Investigation to do an internal investigation.

"Conduct of this nature has not and will not be tolerated at the Johnston County Sheriff's Office," said Bizzell.

Johnson hopes this moment teaches other authorities to respond to mental-health related calls.

"What transpired in my yard should have never transpired," said Johnson.

Former deputy Hollomon is due in court Dec. 6 for a misdemeanor assault charge.
