House Rules debates child marriage bill
The state House Rules committee takes up a bill to increase the minimum age for marriage in North Carolina.

This is an agency bill. Uh, it is concerning captive insurance. Uh, many of you have had the opportunity to hear me speak on this, but real briefly, we'll let you know what a captive insurance actually, captive insurance company actually is. It is a licensed insurance company with the primary purpose of ensuring re ensuring the risk of its owners and, or affiliates. Basically, it's a formalized form of self insurance. They do not provide insurance to the public business owners. Use captives to manage their own business risk. They are licensed and are regulated by the Department of Insurance. So in this bill, what we're attempting to do is to create, uh, an environment in north Carolina that we can be competitive again. Uh, we used to be the fourth largest state in the country for captives. Over time, we've, uh, lack the ability to remain competitive. So what we're doing with this agency bill is attempting to make north Carolina competitive again so that we can get the likes of Home Depot, Duke University, Duke energy lows, get them back down my side in north Carolina, which would be good for the economy. As with the other one did passed unanimously in the Senate, uh with no opposition to two parts to it. It just adds revisions to the N. A. I. C. Credit for reinsurance model law And also incorporates language in the Chapter 58. This is basically a national accreditation cutting to the chase. We really don't have a choice. This bill passed unanimously in the Senate and it passed unanimously in the House and the Judiciary Committee. And basically it is a bill to protect our youngsters um raising the age of marriage to age 16 and then not allowing wider than a four year difference in age for marriage, which protects our young people from poverty and mental and physical health and other disorders. Member thank you. Mr Kent. Uh Senate Bill 301 represent I mean Senator Daniel Gentleman is recognized to speak to Senate Bill 301. Thank you. Mr Chair and members of this committee. Um So the Senate Bill 301 expands slightly on the X function ability. Um And what it does is it allows for up to three nonviolent felony offenses that were committed within a two-year period to be expunged as long as 20 years have elapsed. It only allows this to be done one time. Um It also clarifies that offenses involving impaired driving are not eligible for X functions. Um It does have the support of all the D. A. S in the state. It has the support of a lot of groups that liberal conservative, john locke Foundation Justice Center and so forth. I'm not aware of any opposition. Glad to talk about more particulars if anybody would like to only allows one bite at the apple. So once you choose, you know, you're out under this, you can't go back and ask for other expansions. That's the gist of it. They're just represented. Dixon question for the gentleman recognized, is there any age limitations? I know that in the past we've done Stuff like this and it was for like 21 and under. Now this is, there's no age limitation is the only thing that's really age related is that now that we've raised the juvenile age, there were some offenders who are considered adults at the time they committed their offenses. So this would allow them to go back and to um, you know, expunged offenses that were done while they would have now, under current law, be considered a juvenile represented bowls. And that's it have questions, don't direct knocks And that would be 20 years after 20 years, correct. You can expunge one nonviolent felony after 10 years But you have to choose your remedy. So if you do that, you can't then wait another 10 years and do more. If you want to wait 20 years and do up to three nonviolent felonies, you can do that. Um If that answers your question, german continue to be recognized. And another question they defended. Can they do this on their own hard. Do they have to go through an attorney? I believe the statute says it can be done on motion of the person, an attorney or the district attorney, but staff may want to, but they should use an attorney. Right? Thank mr um They can do it on their own or do an attorney. I checked. I don't recall if it allows the Dhs to make that motion or not. Um Mhm. I don't believe that they can make the motion after this particular statute but they can petition themselves are used to hire an attorney to make that for them and Susan I believe the D. A. Portion may only apply to the folks who would have been juvenile's when they were convicted. You're correct. I just found that yes the D. A. can make the motion if it if the person is petitioning because they were 16 or 17 when they were convicted as an adult under a separate statutes but under the general staff that it would be the person who was convicted or they're returning further discussion or debate. Chairman Hall House Bill 9-11 Regulatory reform to has 11 sections to it. I want to highlight, first of all the changes that were made in the previous version. Previous version had a section dealing with dispensing optician practices that has been removed. Also, previous uh section nine dealing with public records uh exemptions has been a little bit more abbreviated And less exemptions. Section 11, which was a title five hearing requirements has been removed. And then in addition, we have added a bill that clarifies an NC Veterinary Medical Board may not issue civil penalties To veterinary facilities in an amount greater than the current statutory limit of $5,000. And there's also been a slight modification to the language on reflexology ist. And we do expect a friendly amendment on the floor from Representative McNeil on that. And I think that pretty much brings up the changes. If there's other sections you have questions about. I'd be happy to try to answer. Is there discussion debate represented Dixon questions for the representative body, The potential amendment that you referred to? Is that Uh huh. In line with the reflects ologists folks. Yes. So it's a friendly amendment bill to their liking. Yes, it is. Some of you may have uh taken advantage of the reflexology yesterday. They had about 60 different folks that went out and enjoyed the professional practices. And we do have some reflexology is here. Might want to comment later. Uh if you will state your name and who you're you're on behalf of if anyone and speak Up to a time period of one minute, I will try to be as quick as possible. Um My name is Charles Wilkins and I do. I work with the massage and bodywork therapy board. I do most of investigations and prosecutions and discipline with illicit illegal improper unlicensed practices. Um, My concern with the amendment for exempting reflexology is that it will harm our efforts. This body three or four years ago uh gave the board the authority to license establishments and that start that has started right now and started this month. We expect the license to the 3000 establishments that provide massage and bodywork therapy. Our concern is that Anastasia can say we're providing reflexology, we're not providing massage and bodywork therapy and therefore we do not need an establishment licence that will severely harm our efforts. And the establishment licensure was to help combat human traffic. Um We also had an agreement with the reflexology association in 2019 that we would grandfather in those who were currently practicing in North Carolina, But as of March 31 of 2020, any other reflexology is practicing in north Carolina will need to get a massage license. And we had a written agreement that was. Thank you, sir, represented bridal as well as the board and this would be in violation of that agreement. Thank you sir. I am representing the north Carolina Reflexology association And on behalf of our 48 nationally board certified reflexology pistes. Um I want to tell you all how very important that this is that we are allowed to continue to work in the state. We are small businesses were not establishments were mostly women run. So it is individual practitioners with are very loyal and loving clients who keep looking to us for alternative wellness practices. This is really essential for their right to wellness and our right to work. And so we thank you for acknowledging that. Thank you. Uh ephedra neely maybe, probably not. Right. Hello, my name is Pedro nearly. Thanks for having us here. I'm a nationally board certified reflexology pissed and have been practicing for 20 years. I believe what we're trying to do today would help everyone. Uh, the good people of north Carolina so that they may continue to receive this healing work. The last couple of months have been record breaking and you all can imagine the stress levels that people have been under. So it tells me a lot of people need a lot of relaxation. So for the good people in north Carolina to to protect our profession, the reflexology. So it doesn't get watered down and die. And lastly, it actually what Charles was referring to because this qualification of being nationally board certified, they could still go after what they refer to as bad actors. Thank you very much. Thank you, ma'am. And as a member of the committee, no chair often allows the committee members to ask questions of those who wish to speak in the audience and the chair hate staff to cut off. Mr Wilkins Chair did give about a minute and a half or more. Representative riddle was recognized. Thank you Mr Chair. I just want to respond to a couple of things briefly. All right. The agreement Mr Wilkins referred to attacked out in 2019 after the massage board. Administratively without the approval of the legislature. Administratively attempted to gobble up all reflexology ists in north Carolina. That was not right and that got my attention. There's only 48 nationally certified reflexology gist in north Carolina and they're not on a crime spree. Mr Wilkins is out trying to catch bees and he has caught butterflies. They are probably the most harmless people you ever want to meet. You met so many of them yesterday. My concern is that the agreement that has been in place, this simply codifies it. It says it was working okay. If you're a nationally certified and notice nationally certified reflexology pissed you are exempt from the massage board authority. That's it. If you're just out there practicing as a reflex ologists, you come under the massage board. But if you are a nationally certified, if you've taken the extra steps to become nationally certified and by the way, there has never ever been a nationally certified reflexology ist in north Carolina, identified as being involved in any kind of trafficking. You don't like trafficking. I don't like trafficking. They don't like trafficking. So I think it's a spurious argument to make. These are professional people. The guidelines are there and it provides a path for any future. Nationally certified reflexology ist to also enjoy the same exemption, but you have to be nationally certified. Are they, do they have their own LLC or the independent contractors? Uh, Nationally certified uh, Reflex ologists is only 48. An entire state. All right. And they are small businesses, mostly female. I understand, but There? S stabbed. They are 48 business establishment, 48 individuals working okay. And and also follow up, don't track next. How are they paid or they paid through his insurance, health insurance or private faith. Mr. Chair. I defer to one of the reflexology is to answer that question. So the answer to your question is we do not take insurance within the state and we are not trying to establish another licensing board and go through all of that paperwork and issue for you all as well. Um This is trying to just be the most direct path to continuing the work that we've already been doing for the last 20 to 30 years. Further discussion or debate.
