BUT THE JUDGE REJECTED THE EARLIER ORDER FROM A DIFFERENT JUDGE REQUIRING A TRANSFER OF FUNDS TO PAY FOR IT. THAT MONEY WOULD HAVE BEEN USED TO INCREASE EMPLOYEE SALARIES AND HELP MORE STUDENTS WITH DISABILITIES. THE QUESTION OF HOW TO COME UP WITH THE MONEY NOW GOES BACK TO THE STATE SUPREME COURT. THIS DECISION AFFECTS EVERY ONE OF NORTH CAROLINA'S 1.5 MILLION PUBLIC SCHOOL STUDENTS. SEVERAL GROUPS RESPONDED TO THE RULING LATE TODAY, INCLUDING THE PARENTS, STUDENTS AND EDUCATORS WHO MAKE UP EVERY CHILD IN C THEY CALLED THE RULING. GOOD NEWS SAYING IN PART HIS COMMON SENSE ORDER CONFIRMS THAT OUR STUDENTS ARE STILL OWED 785 MILLION DOLLARS TO FUND YEARS 2, 3 OF THE LEANDRO PLAN NOW SIMILAR RESPONSE FROM THE NORTH CAROLINA JUSTICE CENTER. THEIR STATEMENT READS IN PART, NORTH CAROLINA, CHILDREN, PARTICULARLY THOSE LIVING IN POVERTY, MULTILINGUAL LEARNERS, STUDENTS OF COLOR AND STUDENTS WITH DISABILITIES HAVE WAITED FAR TOO LONG FOR THE CONSTITUTIONAL RIGHTS TO BE ENFORCED. WE CANNOT AFFORD TO WAIT ANY LONGER. RICK GLAZER IS EXECUTIVE DIRECTOR OF THE NORTH CAROLINA JUSTICE CENTER. AND HE'S BEEN INVOLVED IN HIS LEGAL BATTLE FOR YEARS. RICK, WE'RE HAPPY TO HAVE YOU TODAY. FIRST QUESTION WE'VE BEEN HERE BEFORE. A JUDGE SAYS THE STATE MUST FUND THE REMAINDER OF THE PLAN BUT DOESN'T SAY HOW SENDING THIS RESPONSIBILITY BACK TO THE STATE SUPREME COURT. SO WHERE DO WE GO FROM HERE? >> WELL, JUDGE ROBINSON GERALD WAS DOING THE JOB THAT HE WAS TASKED WITH DOING BY THE SUPREME COURT, WHO AFTER THE LONG SESSION OF THE LEGISLATURE AND HAVING THIS CASE TRYING TO HOW MUCH MONEY WAS ALLOCATED BY THE LEGISLATURE TO MEET THE ONE-POINT-SEVEN BILLION DOLLARS THAT IT APPEARED AS A RESULT OF JUDGE LEE'S ORDER. I'M TRYING TO FIND THE AMOUNT THAT WAS NECESSARY TO ADEQUATELY FUND. EACH STUDENT'S OPPORTUNITY FOR SOUND BASIC EDUCATION AND TO MEET THE CONSTITUTIONAL MANDATE. HE DID THAT BY FINDING IS YOU SAID ABOUT 785 MILLION IS STILL NEEDED FOR YEARS. 2, 3, OF THE PLAN, HIS SIDE COMMENT, WHICH IS ABOUT THIS WAY TO SAY ABOUT THE WHO PAYS REALLY. HE HAD NO JURISDICTION TO MAKE. AND SO I THINK THAT SORT OF A NON-ISSUE, THE CASE IS REALLY NOW FIRMLY BEFORE THE SUPREME COURT. WITH THE KNOWLEDGE THAT THAT THE STATE HAS 785 MILLION, THAT THEY NEED TO MEET THE CONSTITUTIONAL MANDATE FOR ALL OF OUR STUDENTS AND THE ISSUE BEFORE THE SUPREME COURT IS SIMPLY WHETHER THE COURTS OF NORTH CAROLINA HAVE THE ABILITY TO ORDER THE LEGISLATURE TO PAY THE REMAINDER OF THOSE FUNDS IN THE NEXT 5 YEARS OF THOSE FUNDS IN ORDER TO MEET THE CONSTITUTIONAL MANDATE. THAT'S BEEN THE ISSUE THAT'S BEEN PRESENTED AND IT IS REALLY THE MOST IMPORTANT CONSTITUTIONAL ISSUE. PROBABLY OUR SUPREME COURT HAS FACED IN A NUMBER OF DECADES. WHAT DO YOU SEE AS THE MOST LIKELY OUTCOME IN THIS? WELL, THE FUNDING BE DISTRIBUTED OR >> WILL THIS BE AN ONGOING CYCLE FOR YEARS TO COME? >> WELL, I YOU KNOW, I THINK A LOT OF US WANT THE SUPREME COURT TO RULE SO THAT WE KNOW EXACTLY HOW WE'RE GOING TO APPROACH THIS. BUT FRANKLY, IT IN THE LEGISLATURE HAS AN OUT AND THAT OUT IS LED BY DEMOCRATIC CONFEREES BY SENATOR CORRECTIVE YEAR, CUMBERLAND AND REPUBLICAN LEADERSHIP. THEY FUNDED ABOUT 60% OF 2, 3, OF THE PLAN OVER A BILLION DOLLARS. AND SO THEY COULD IN THE SHORT SESSION, GERALD, COMING UP, MEET THE SORT OF MOVE THE CASE IN PART BY FUNDING THE 785 MILLION ON THEIR IF THEY CHOOSE NOT TO DO THAT, THEN THE CASE IS FIRMLY BEFORE THE SUPREME COURT. AND IT, I THINK NEEDS TO FOR THE REMAINDER OF THE CASE. AND REALLY SO IT'S CLEAR, BUT NO, NO ABILITY OF ANY PORTION OF THE GOVERNMENT TO ABDICATE ITS RESPONSIBILITY UNDER THE CONSTITUTION. THEY DON'T GET TO AVOID THE JUDGMENT. THEY DON'T GET TO NOT PAY. RICK. EVERYONE AGREES THAT THE FUNDING IS NECESSARY AND THERE IS A FUNDING DISPARITY ACROSS NORTH CAROLINA. PUBLIC SCHOOLS. >> IS LEANDRO THE END. ALL BE ALL OF THE CHEATING EDUCATION EQUALITY IN NORTH CAROLINA. >> NO, BUT IT'S A BIG STEP AND IT'S BEEN PENDING FOR 25 YEARS. IT'S CLEAR AFTER THE BEST EDUCATION FINANCE STUDY IN THE COUNTRY THAT WAS RUN AND IT'S CLEAR THAT THE STATE BOARD OF EDUCATION, THE GOVERNOR HAS SIGNED OFF ON THE CONSENT DECREE THAT ESSENTIALLY MAKES MAKES MAKES MAKES CLEAR WHAT'S NEEDED TO MEET THE CONSTITUTIONAL MINIMUM AND MANDATE. MONEY ALONE ALWAYS IS NOT THE ANSWER. TARGETED MONEY IS IMPORTANT. BUT IN A BASE LEVEL, RESOURCES ARE CRITICAL. AND SO IT IS ALL A PART OF A PLAN THAT GOES INTO NOT JUST LOOKING AT WHAT MEETS THE CONSTITUTIONAL MINIMUM IN TERMS OF MONEY, BUT HOW IT'S SPENT WHERE IT SPENT, HOW IT'S TARGETED AND ALL THAT IS ONE PACKAGE. WE DON'T GET TO SORT OF PICK AND CHOOSE BETWEEN UP A AND B AND AND SEE. Our 1st 90 degree day of the year is looking likely today 90 is what we're forecasting for Durham Raleigh and Fayetteville. 89. For most other areas around our viewing area, it's a hot one outside the sun feels extra hot today. One of the reasons why we may actually hit 90 is because the air is a bit drier outside today. At least it's not as humid though over the weekend, humidity climbs, but we've got a lot more moisture heading our way. We could see some scattered storms return. Saturday is not looking all that wet though. That's good news. It's a 40% chance of rain and storms mostly dry in the morning. 82 and rain possible on Sunday with some isolated a high near 80. The good news is there's only a 20% chance of rain on Saturday morning for the Coleman race for the cure. Meteorologist, Mike Mays will be one of the M CS out there so you can check in with him for forecasts to updates throughout the race. It will be around 67 at 7 a.m. and by one o'clock, rain chances up a little bit temperatures near 80. We also have the Ham and Yam festival happening in Smithfield starts at 10 a.m. Saturday. It looks drier early on, but a bit later on into the festival, we could see some scattered thunderstorms develop. We finally have some high resolution model data to look at for Saturday throughout the day, Friday, we expect dry weather but we still have a small 20% chance of rain. Friday night. Futurecast not showing a very high chance Saturday. We could see some storms fire up during the afternoon. Notice the spacing of these storms here. I wouldn't take the placement of them too literally. But the radar is not covered in storms everywhere in central North Carolina though, we do really need the rain. The new drought monitor is in, it's showing abnormally dry conditions for pretty much the entire viewing area. Now, we're hopeful that we'll get some more rain in the coming weeks and it does look like we'll transition to a wetter pattern and hopefully that will keep a flash drought at bay. Our muggy meter is climbing though. So enjoy the more comfortable air while you can. Once we get to the weekend, it'll feel more humid. And especially next week, the heat sticks around next week, but the humidity will be climbing. We've got a couple of 90 degree days today and tomorrow temperatures fall a bit over the weekend with more clouds and a chance for rain. And then as we get into next week, temperatures are likely to climb right back into the nineties. By the time we get to Wednesday.
