A Smithfield man shot and killed his brother on Wednesday night, authorities said.



<b>SMITHFIELD, N.C.</b> — A Smithfield man shot and killed his brother on Wednesday night, authorities said.

The shooting happened shortly before 7 p.m. at an apartment complex on Stevens Sausage Road.

Deputies said Joseph Earl Horton, 27, who lives at the complex, shot Stephen Patrick Horton, 42, of Smithfield, on the front lawn.

After collecting evidence and interviewing witnesses, investigators consulted with the Johnston County District Attorney's Office and decided not to file charges in the case.

The shooting remains under investigation.
