FAYETTEVILLE, N.C. — Fayetteville police say Officer Michael Morin was parked at the intersection of Dashland and Fieldcrest drives Sunday night keeping an eye on traffic when Desiree Smith, 26, fired a gun at him.

Around 11:20 p.m., Morin saw a 2006 Chevy Impala run through a stop sign. Before Morin could turn on his lights and siren, he saw a muzzle flash from the driver's side window and heard gunshots.

“As soon as he saw that she was firing shots, he initiated his emergency equipment and she began to flee,” said Sgt. Jeremy Glass, a police spokesman.

The officer's car was not hit and he never returned fire.

Police say just a block away, her car broke down.

They say while the officer was following her, she threw out a stolen handgun.

Police recovered the gun on the ground along with three shell casings. A prosecutor says a shell casing fell from her lap when she got out of the car.

Smith was arrested.

Police said a car driven by Desiree Breshay Smith, 26, of Corrinna Street in Fayetteville, ran a stop sign around 11:30 p.m. Police said Smith tried to flee the scene and fired gunshots at an officer.

In her first court appearance, she told the judge, "I've never been in trouble before - never, ever."

"I'm not guilty of anything they're saying. I work, I go to school."

Glass says he doesn't know why Smith fired at the officer and that she wasn't wanted for any crimes in the county.

She was not cooperative with investigators.

Glass says it's a blessing nobody was hurt, but that it's always unnerving when someone fires at an officer.

“I’ve been at work when an officer was shot and shot at. It always gets your adrenaline pumping. Of course, you want to get there as fast as you can, as safe as you can,” Glass said.

Smith was charged with felony assault with a deadly weapon on a government official, possession of a stolen firearm, felony flee to elude arrest, and fail to stop at a stop sign, and careless and reckless driving.

Smith is currently in the Cumberland County Detention Center under a $100,000 secured bond.
