MOUNT OLIVE, N.C. — A state Department of Justice panel has found no probable cause to investigate the former police chief of Mount Olive.

Emmett Ballree resigned in July 2007 amid allegations he used a town credit card at a gas station to fill the tank of his personal vehicles. Mount Olive officials declined to press criminal charges after he left.

The state case could have led to the suspension or revocation of Ballree's law enforcement certification.

Ballree now is police chief in the Brunswick County town of Boiling Springs Lake.
