RALEIGH, N.C. — Contrary to some reports, “Two and a Half Men” star Charlie Sheen’s wife Brook Mueller is not in rehab in North Carolina, Mueller’s lawyer Yale Galanter told WRAL News on Wednesday.

“Entertainment Tonight” and TMZ reported on their Web sites Wednesday morning that Mueller had checked into a rehab facility in North Carolina. TMZ later posted a story saying she wasn’t in rehab.

“She is in North Carolina with her mom for some rest and relaxation pursuant to doctors orders. She is still recovering from her recent infection and pneumonia,” Galanter wrote in an e-mail to WRAL.

Mueller was hospitalized last week for treatment of an infection after oral surgery. She was released Monday night.

Sheen visited his wife when she was in the hospital, but now that she is out, a court order keeping them from contacting each other remains in full effect, according to Galanter.

The Sheens have a Feb. 8 court date in Aspen in the aftermath of a domestic violence incident that brought police to their Colorado home on Christmas Day .

Galanter said Monday they will ask for modification of the no-contact order. Sheen is also set for arraignment that day on domestic violence charges.
