Durham County to pay $790,000 to former county manager who claimed discrimination

Durham County Commissioners voted to settle a lawsuit from the former county manager.

DURHAM, N.C. — Almost two years after the controversial firing of the county manager, Durham County Commissioners voted to settle a lawsuit from that former employee.
Wendell Davis was ousted in a 3-to-2 vote in May of 2021. He filed suit in January of 2022.

Some commissioners called the vote racist at the time.

Davis was named county manager in 2014.

His lawsuit claims race and sex discrimination played a role in his firing by Durham County Commissioners. Now, the Board has voted to settle and pay him $790,000.

In a 3-to-1 vote, Durham County Commissioners settled a lawsuit from the former county manager.

Commissioner Heidi Carter voted against the settlement.

The vote came after a long discussion in closed session, led by the county attorney.

Wendell Davis' lawsuit points to "constant undermining, belittling, and humiliating" actions by the Board of County Commissioners.

His filing last January asked for damages related to mental anguish and stress, as well as harm to his career opportunities.

In addition to the lump sump of almost $800,000, as part of the settlement, Durham County admits no liability.

Each party will pay their own legal fees. The settlement also says Davis will dismiss his lawsuit and it cannot be re-filed.

When asked for comment, county commissioners directed any questions to the county attorney, citing the legal matter.
