Driver faces additional charge in comedian's DWI death

A High Point man who Durham police say was driving drunk when he allegedly killed a stand-up comedian over the weekend faces an additional charge in the case.

DURHAM, N.C. — A High Point man who Durham police say was driving drunk when he allegedly killed a stand-up comedian over the weekend faces an additional charge in the case.

Raul Herrera, 31, was charged Wednesday with felony death by motor vehicle in the death of Brian Edward Kiley, 38, of Goodlettsville, Tenn.

Kiley had just finished a show in Catawba County and was headed to Raleigh-Durham International Airport around 3:40 a.m. Sunday to catch a flight back to Tennessee when, authorities said, Herrerra lost control of his car on Interstate 40 and crashed into him.

Herrera also has been charged with driving while impaired.

Kiley will be buried Saturday in Nashville.
