Former Durham Co. deputy drops lawsuit centered around COVID vaccination requirement

The federal lawsuit filed by former Deputy Christopher Neve against Sheriff Clarence Birkhead and the Durham County Sheriff's Office over the COVID-19 vaccine has been dismissed at Neve's request.

DURHAM, N.C. — The federal lawsuit filed by former Deputy Christopher Neve against Sheriff Clarence Birkhead and the Durham County Sheriff's Office over a COVID-19 vaccine requirement has been dismissed at Neve's request.
In May, the former Durham County deputy sued Birkhead, claiming that he was fired because he wouldn't comply with the sheriff's mandate that all deputies be vaccinated against coronavirus.

Neve had argued that he questioned the safety of the vaccine and should not be required to get the shot. He asked a federal judge to declare the vaccination requirement unconstitutional and to reinstate him, with back pay and benefits.

The sheriff's office announced Wednesday morning that the suit was dismissed but had no further comment.
