Authorities release body camera footage in fatal Moore County officer-involved shooting

Authorities on Friday released body camera footage in the case of Arthur Kenzie Garner, who was killed on July 28 when officers arrived at his house following a call for help from the residence.

ABERDEEN, N.C. — Authorities on Friday released body camera footage in the case of Arthur Kenzie Garner, who was killed on July 28 when officers arrived at his house following a call for help from the residence.

Immediately after the July 28 shooting, investigators said that when deputies arrived at the scene, Garner began firing at the law enforcement officers, who returned fire and killed him.

On Aug. 11, Moore County Sheriff Neil Godfrey said the initial report was wrong and Garner never fired at deputies.

"At this time, we do not believe that Garner ever fired at our deputies," the sheriff said in an emailed statement last month. "However, based upon statements made by Garner’s father, he did attempt to shoot his weapon."

In the video footage, several people can be heard off-camera yelling at Garner to put the gun down before about 9 seconds of gunfire erupt. Someone is then heard yelling "cease fire," but another single shot is fired several seconds later.

Officers are then heard yelling at someone in the home to "stay down." Several minutes later, a law enforcement officer can be heard yelling "ma'am, are you OK in there," but it is unclear who he is speaking to.

At one point, officers say they see movement in a window in the house and a woman is heard telling people to back away from the home.

About a minute later, officers can be heard saying they have recovered a gun near the door as they enter the home.

"We've got him down," an officer says as a group walks inside.

"We've got blood here on the wall," another says.

As officers are inside they home, they can be heard telling a family member to stay where she is. They then begin yelling "get out" to a woman as they struggle with her in the doorway and she screams "I hate you all" while sobbing.

"I was hiding in there and the bullets are all in there," another woman tells police as they enter a room in the home shortly after.

Later on, officers are heard discussing the incident.

"I could see a clear version, him with the gun. Then I shot the shots, I shot two and I took two more at the window," one officer said. "I fired two at the door. I could still see him at the window, so I fired two more."

Godfrey previously identified the four deputies involved in the incident as Sgt. Sean Ballard, Cpl. Dustin Hussey, Stephanie Griffin and Justin Mack. All of the deputies were placed on administrative leave while the State Bureau of Investigation completes a probe, which is standard procedure for officer-involved shootings.

Aberdeen police Chief Tim Wenzel has said one of his officers, identified as Officer Austin Whatley, was at the scene when the incident occurred but he did not fire his weapon.

Pinehurst police have said Sgt. Jason Caulder and Officer Michael Muse were at the scene when the shooting occurred. The video released Friday was from body cameras worn by the Pinehurst officers.

Garner's family said they called 911 after he had a fight with his girlfriend, which began escalating. His mother previously told WRAL News her son had been in and out of jail before, but didn't deserve to be killed.
