Driver charged in car's fatal collision with train in Cary
Police on Thursday charged a Laurinburg man whose girlfriend was killed last week when an Amtrak passenger train hit his car at a Cary rail crossing.

Benny Derrick Dimery, 24, is charged with involuntary manslaughter in the Jan. 2 death of Lauren Webb, 21, also of Laurinburg. The felony charge carries a penalty of 33 to 41 months in prison.
The northbound Amtrak Silver Star hit the passenger side of Dimery's Mitsubishi Galant at the Maynard Road crossing near Old Apex Road.
Witnesses said Dimery drove around the lowered crossing arm before the collision. A crash report from the Cary Police Department said the car went into the center turn lane and passed stopped vehicles before going around the crossing arm.
Dimery was critically injured in the crash, but police said Thursday that he is expected to recover from his injuries.
None of the 291 people aboard the Silver Star, which was heading from Miami to New York, was injured, officials said.
