Woman filed $400K lawsuit against Dollywood after tripping out of ride

A New Jersey woman has filed a $400,000 lawsuit against Dollywood claiming she fell and fractured her wrist as she was getting off the Rockin' Roadway ride in March 2017.

PIGEON FORGE, TENNESSEE — A New Jersey woman has filed a $400,000 lawsuit against Dollywood claiming she fell and fractured her wrist as she was getting off the Rockin’ Roadway ride in March 2017.

Attorneys for Judy Lynn Etherton filed the lawsuit earlier this month in U.S. District Court in Knoxville, TN. The lawsuit names the Dollywood Company, Herschend Family Entertainment Corporation and Dolly Parton Productions as the defendants.

According to the lawsuit, Etherton said she fractured her right wrist after attempting the exit the Rockin’ Roadway ride at Dollywood on March 19, 2017.

The ride does not have doors, and riders are required to step over the side of the ride to exit. As she attempted to exit, her foot caught the side of the ride, causing her to be thrown to the ground resulting in her injuries, the lawsuit said.

The lawsuit also claims the fall was due to there being no safety devices in place to assist people from exiting the ride.

The claims being made against the defendants include:

Failure to properly operate and maintain the Rockin’ Roadway ride.

Failure to properly instruct guests about a safe exit from the ride.

Failure to adequately supervise and oversee patrons to prevent them from injuring themselves when exiting the ride
