Kenneth Terry Bottom, 46, of Apex, was delivering a replacement cab to a AAA Cooper Transport truck that had broken down at the Jones Sausage Road interchange at I-40 about 11:15 a.m., authorities said. He was trying to cross the highway and walked into the path of a Mitsubishi on the ramp, they said said.

Bottom was taken to WakeMed, where he was listed in critical condition.

No charges will be filed against the driver of the Mitsubishi, Josalyn Murphy, 23, of Raleigh, authorities said.

The crash closed one eastbound lane of I-40 for more than an hour as state troopers investigated the incident.

I saw this happen and was with Mr.Bottom till EMS arrived. The young lady who hit him was so upset and so concerned for him. He wasn't concious and wasn't suffering when he was waiting for help. Please everyone pray for him as well as the driver who will never fully forgive herself for what she surely didn't mean to do.

This is a very sad thing to have happen to anyone, truck driver or not. My prayers go out to his family but I do have one question. If this has been declared an accident, and no charges are to be filed, why is it necessary to to put this young woman's name out to the public? Doesn't she have enough problems to deal with without having the world know her name? There is no doubt she is going to lose a lot of sleep, and most likely need proffessional help to get past this traumatic event.

Prayers to the driver as a professional driver ramps and vehicles on the side are a exteme danger and although the driver was not at fault we should all make ourselves of the hazards or potential hazard of any vehicle on the shoulder of the highway.
