Teen brothers indicted on murder charges in fatal shooting

— A Wake County grand jury on Monday indicted two teenage brothers in connection with the shooting death this summer of a 16-year-old boy.

Brayan Hernandez-Sierra, 13, and Ceferino Hernandez-Sierra, 15, were each indicted on a count of murder in the death of Fernando Garibay-Benitez. He was shot in the head on Aug. 15 while he was walking home from the store.

Witnesses testified in a hearing last week that Brayan Hernandez-Sierra fired several shots from a minivan driven by his brother.

Investigators believe the shooting was gang-related.

The pair had been initially under the jurisdiction of the juvenile court system, but a judge last week found that they could be tried as adults.

Still, they are ineligible for the death penalty. A U.S. Supreme Court ruling limits it to those over age 18 at the time of a capital crime.

    "Where was the boys' mother?" - gingerlynn

    What does it matter? That question is irrelevant given these kids had access to a vehicle and a gun. The Mother was MIA plain and simple...

    Where was the boys' mother? They had her van? Something just doesn't add up and now she has lost two children and another mother one child.

    If you are old enough to point a gun at another person's head and pull the trigger, then you are old enough to face the death penalty. It amazes me how mean some of today's youth can become in such a short life.

    As a friend once told me, I'm in the fourth quarter hoping for overtime in the cycle of life. Even at my "old" age, I couldn't imagine shooting another person in the head without provacation.

    Don't underestimate what a 13 year old that's been involved with gangs is capable of. He's responsible in the end but he likely was never in a position to make much of his life from the start. He knew what he knew, and that was to be tough, be mean, or wind up dead like the 16 year old. Said that they thought that's what life is supposed to be about

    Not sure about 13, but yes 15 for sure. Now for the 13 year old, I'm sure the parents will be facing some charges, if not civil suit for wrongful death.
